ACCEPTABLE USE AGREEMENT This acceptable use policy governs your use of the Cisco Partner Talent Portal Website (the “Website”).

Acceptance 
These terms of use, which specifically incorporate the Cisco Privacy Policy , state Cisco’s requirements for your use of the Website.  Use of the Website constitutes acceptance of these legal terms and conditions.  If you do not agree to these terms, please cease all further use of the Website.  Cisco may amend these terms at any time by posting the amended terms at this URL no less than five (5) days prior to the effective date of such amendment.  Your use of this Website after the effective date of the changes will signify your express acceptance of them.

 
Eligibility.
The job posting, resume database and other features of the Website may be used only for lawful purposes by (1) individuals seeking employment and career information, and (2) Cisco partners seeking employees (together, “Users”).


Collection of Personal Information

If you are an individual using the Website to seek employment from a Cisco partner, you acknowledge and agree that Cisco may collect personally identifiable information from you and use such information in accordance with Cisco Privacy Policy, which is available here.  All User Content (as defined below) that you provide will be accessible by, and may be shared with, Cisco and its partners that may be seeking to hire employees.


User Content

You are solely responsible for your content, including: your profile information, resume, employer account information or job postings, messages, audio, video, photos, text, or other information (collectively, "User Content”).


License

By submitting your content, you agree that Cisco may use the content for any purpose, indefinitely, and without compensation to you.


Use Restrictions

You may not post false, misleading, inaccurate, threatening, libelous, defamatory, obscene, pornographic, or other material that would violate any law or which contains any computer programming routine that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information.
You also agree not to: (a) If you are a Cisco partner, use the Website for any purpose other than as an employer seeking employees, including but not limited to using the information on the Website to sell or promote any products or services; (b) send unsolicited mail or e-mail, make unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a User; or (c) aggregate, copy or duplicate in any manner the content or information available from the Website, without Cisco’s written consent.

Own Risk

Content posted to the Website is not prescreened.  While Cisco may monitor the Website, it does not have the obligation to do so, and may remove any content which it feels violates this agreement.  You acknowledge that any reliance on User Content, or any third party link, will be at your own risk.

Ownership

Everything hosted on this Website, with the exception of User Content , is owned by Cisco or its suppliers or partners.  All rights to the contents on this Website are reserved.  You may not reproduce any portion of the contents of this Website without Cisco’s prior written consent. 


Confidentiality

You are responsible for maintaining the confidentiality of your account, registration and password information, and for all uses of this information, whether or not authorized by you.


Termination

Cisco may immediately suspend or terminate your access to the Website if you violate the terms of this Agreement.  Upon doing so, Cisco may retain or delete, in its sole discretion, any content that you provided to the Website.  In addition, Cisco may cease to provide and maintain the Website at any time.


Disclaimer and Liability

Cisco is not responsible for any job placement, career development, or other professional opportunities that may be presented, discussed, or referred to on the Website.  Cisco is not involved in the actual employment transaction between Cisco partners and candidates.  You should independently confirm the truth and accuracy of all information that you obtain from this Website before relying on any such information.
ALL INFORMATION PROVIDED BY CISCO ON THE WEBSITE IS PROVIDED “AS IS” WITH ALL FAULTS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.  CISCO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. Miscellaneous

This Agreement shall be governed by the laws of the State of California in the United States of America, without giving effect to any conflict of laws rules or principles that would require the application of the laws of a different jurisdiction. If any provision of these terms of use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.  Cisco’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
